How Gravity Engineering Services Pvt. Ltd. collects, uses, and protects your information when you use OpenTalent -- and the terms under which the OpenTalent platform and services are provided.

This Privacy Policy explains how Gravity Engineering Services Pvt. Ltd. ("OpenTalent", "we", "us", "our") collects, uses, discloses, and protects personal data when you use the OpenTalent website at opentalent.in, the talent platform at talent.gravityer.com, and our related services (collectively, the "Services").
We process personal data in accordance with India's Digital Personal Data Protection Act, 2023 ("DPDP Act") and applicable Rules. Where required, we also align with other applicable data protection laws.

2.Information we collect
We collect personal data that you provide to us directly, that we generate as you use the Services, and that we receive from third parties you have authorized.
Information you provide
- Account & profile data -- name, email, phone, country, role, employer, professional title, profile photo, password (stored as a salted hash).
- Talent profile -- resume, work history, education, skills, portfolio links, code samples, project descriptions, references, expected compensation, availability.
- Hiring brief data -- for employers: scope, role description, team context, billing details.
- Assessment data -- interview recordings (where you consent), scored assessments, project submissions, panel feedback.
- Support & communications -- messages you send us by email, chat, or form.
Information generated by your use
- Usage data -- pages visited, features used, search queries, clicks, sessions, referrer URLs.
- Device & log data -- IP address, browser type, operating system, device identifiers, timestamps, crash logs.
- Cookies & similar technologies -- see Section 10.
Information from third parties
- SSO providers -- Google, GitHub, or LinkedIn profile data when you sign in with them.
- Verification & reference checks -- with your explicit consent only.
- Public sources -- public professional profiles or repositories that you point us to.
3.How we use your information
We use personal data for the following purposes, each tied to a specific, lawful, and stated reason:
- To operate, maintain, and improve the Services.
- To create and manage your account and authenticate you securely.
- To screen, vet, and match talent with hiring opportunities -- including running our five-stage screening process.
- To share matched candidate profiles with prospective hiring clients, in accordance with your consent.
- To facilitate, contract, and bill for engagements between talent and clients.
- To send service notifications, security alerts, and other transactional messages.
- To send marketing communications, where you have opted in (you can opt out any time).
- To detect, prevent, and respond to fraud, abuse, security incidents, or violations of our Terms.
- To comply with applicable law, regulation, court orders, and lawful requests by public authorities.
- To conduct internal research, analytics, and product development, using aggregated or de-identified data wherever feasible.
4.Legal grounds for processing
Under the DPDP Act, we process personal data on one or more of the following grounds:
- Consent -- for purposes you have explicitly agreed to, such as creating a talent profile, sharing your profile with employers, or receiving marketing communications.
- Legitimate uses -- including providing the Services you have signed up for, meeting employment-related obligations under applicable law, and responding to medical or safety emergencies in the manner permitted by law.
- Legal obligation -- for processing required by applicable law, regulation, or judicial order.
You may withdraw consent at any time as described in Section 8. Withdrawing consent may limit our ability to provide the Services.
5.Sharing & disclosure
We do not sell personal data. We share it only as described below:
- With hiring clients -- we share talent profiles and relevant assessment information with hiring clients you have agreed to be presented to, under written confidentiality terms.
- With service providers -- cloud hosting, email delivery, analytics, payment processing, KYC and verification partners, and similar vendors who process data on our behalf under written data processing agreements.
- With professional advisors -- auditors, lawyers, and accountants, under confidentiality obligations.
- For corporate transactions -- in connection with a merger, acquisition, financing, or sale of all or part of our business, with appropriate confidentiality protections.
- For legal reasons -- when required by law or to protect rights, safety, property, or the integrity of the Services.
6.International transfers
OpenTalent is a global network. Personal data may be transferred to, stored, and processed in countries other than your country of residence, including the United States, the European Economic Area, the United Kingdom, the United Arab Emirates, Singapore, and Australia.
When personal data is transferred outside India, we do so only to jurisdictions permitted under the DPDP Act and applicable Rules, and we put in place appropriate safeguards -- including contractual commitments with our processors and clients to apply protections substantially equivalent to those under Indian law.
7.Retention
We retain personal data only for as long as it is necessary for the purposes for which it was collected, including to satisfy legal, tax, accounting, or regulatory requirements, and to resolve disputes.

8.Your rights
Subject to the DPDP Act and applicable law, you have the right to:
- Access the personal data we hold about you and obtain a summary of how it is processed.
- Correct inaccurate, incomplete, or misleading personal data.
- Update your information directly through your account, or by writing to us.
- Erase personal data we no longer need, subject to legal retention obligations.
- Withdraw consent previously given, at any time.
- Nominate another individual to exercise your rights in the event of your death or incapacity.
- Grievance redressal -- see Section 13.
To exercise these rights, write to privacy@opentalent.in from the email associated with your account. We will respond within the timelines required by applicable law.
9.Security
We implement reasonable security safeguards designed to protect personal data against unauthorized access, alteration, disclosure, or destruction, including encryption in transit (TLS 1.2+), encryption at rest for sensitive data, role-based access controls, multi-factor authentication for privileged access, periodic vulnerability testing, vendor due diligence, and an incident response process.
No system is perfectly secure. If we become aware of a personal data breach, we will notify the Data Protection Board of India and affected users in accordance with the DPDP Act and applicable Rules.
10.Cookies & similar technologies
We use cookies and similar technologies to operate the Services, remember your preferences, measure usage, and improve the product. You can control cookies through your browser settings; declining non-essential cookies will not prevent you from using core features of the Services.

- Analytics cookies -- help us understand how the Services are used, in aggregate.
- Preference cookies -- remember your settings and choices.
11.Children
The Services are not directed to individuals under 18 years of age. We do not knowingly process personal data of a child without verifiable parental or lawful guardian consent. If you believe a child has provided us with personal data without such consent, please write to privacy@opentalent.in and we will take appropriate action.
12.Changes to this Policy
We may update this Privacy Policy from time to time. We will post the updated version on this page and update the "Last updated" date. For material changes, we will provide additional notice, such as by email or an in-product notification.

We will acknowledge grievances within 7 business days and resolve them within the timelines required by the DPDP Act and applicable Rules.
If your concern is not resolved, you may approach the Data Protection Board of India in accordance with applicable law.

These Terms of Service ("Terms") govern your access to and use of the OpenTalent website, the talent platform, and our related services (the "Services"), provided by Gravity Engineering Services Pvt. Ltd. ("OpenTalent", "we", "us", "our").
1.Acceptance of these Terms
By creating an account, accessing, or using the Services, you agree to these Terms and our Privacy Policy above. If you are accepting these Terms on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes that organization.
If you do not agree to these Terms, you may not access or use the Services.
2.The service
OpenTalent operates an AI engineering talent network. The Services may include, among other things, listing and matching of vetted talent profiles, screening and assessment workflows, employer onboarding, engagement contracting, billing, and related communications.
We may update, modify, or discontinue features of the Services at any time. We will use reasonable efforts to provide notice of material changes.
3.Accounts & eligibility
- You must be at least 18 years of age to use the Services.
- You must provide accurate, complete, and current information when you register.
- You are responsible for safeguarding your credentials and for all activity that occurs under your account.
- You must notify us immediately of any unauthorized access or other security incident concerning your account.
- We may suspend or close accounts that we reasonably believe violate these Terms or applicable law.
4.Engagements between talent and clients
OpenTalent introduces and helps facilitate engagements between independent talent and hiring clients. Unless explicitly stated otherwise in a written agreement signed by an authorized representative of OpenTalent:
- OpenTalent is not a party to the underlying employment, contracting, or services relationship between talent and a client.
- OpenTalent does not employ talent, and talent does not represent OpenTalent.
- The specific terms of an engagement -- scope, deliverables, compensation, IP assignment, confidentiality, termination -- are governed by the engagement agreement entered into between the talent and the client.
- OpenTalent provides a master services framework that engagements may be executed under, where applicable.
5.Fees, billing & payouts
Fees applicable to your use of the Services will be set out in your order form, statement of work, or other written agreement with us. Unless stated otherwise:
- Fees are quoted in Indian Rupees (INR) or US Dollars (USD), exclusive of applicable taxes.
- Invoices are payable within the period stated on the invoice. Late payments may accrue interest at the rate permitted by applicable law.
- For talent payouts, we will remit amounts as specified in your talent agreement, subject to applicable withholding and tax obligations.
- Disputes over invoices must be raised in writing within 30 days of the invoice date.
6.Acceptable use
You agree not to use the Services to:
- Violate any applicable law, regulation, or third-party right.
- Misrepresent your identity, qualifications, employment status, or organization.
- Submit false, plagiarized, or AI-generated work product as your own through our screening, where original work is required.
- Circumvent our screening, matching, or fee structures -- including by soliciting introductions made via the Services off-platform during the protection period defined in your engagement agreement.
- Upload malware, viruses, or other harmful code.
- Scrape, harvest, or extract data from the Services other than as expressly permitted.
- Interfere with, probe, or disrupt the integrity or performance of the Services.
- Use the Services to harass, threaten, defame, or discriminate against any person or group.
7.Intellectual property
OpenTalent and its licensors own all right, title, and interest in and to the Services, including software, design, content, trademarks, and goodwill, except for content you provide. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for their intended purpose.
You retain ownership of content you submit ("User Content"). By submitting User Content, you grant us a worldwide, royalty-free, non-exclusive license to host, process, transmit, display, and use it solely as needed to operate and improve the Services and to perform the matching, screening, and engagement functions you have asked us to perform.
The allocation of intellectual property generated during an engagement is governed by the engagement agreement between the talent and the client.
8.Confidentiality
Each party agrees to protect the other's non-public information disclosed in connection with the Services with reasonable care, to use it only for the purposes of the Services, and not to disclose it to third parties except to its personnel, advisors, and processors who have a need to know and who are bound by comparable confidentiality obligations.
This obligation does not apply to information that is or becomes public through no fault of the receiving party, is rightfully received from a third party without restriction, or is independently developed without use of the disclosing party's information.
9.Warranties & disclaimer
We provide the Services with reasonable care and skill, and we work hard to keep them secure and available. To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.
We do not warrant that talent presented through the Services will meet your specific requirements, that engagements will achieve any particular outcome, or that the Services will be free of errors.
10.Limitation of liability
To the maximum extent permitted by applicable law:
- Neither party will be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost revenue, lost data, or business interruption.
- Each party's aggregate liability arising out of or in connection with these Terms or the Services will not exceed the total fees paid or payable by you to OpenTalent in the twelve (12) months preceding the event giving rise to the claim.
- These limitations apply regardless of the legal theory of the claim and even if a party has been advised of the possibility of such damages.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or gross negligence.
11.Indemnity
You agree to defend, indemnify, and hold harmless OpenTalent and its affiliates, officers, employees, and contractors from any third-party claim, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your User Content; (b) your use of the Services in violation of these Terms or applicable law; or (c) your engagement with another user of the Services outside the scope of OpenTalent's role under Section 4.
12.Suspension & termination
We may suspend or terminate your access to the Services, with or without notice, if we reasonably believe you have breached these Terms, created legal or operational risk for us or other users, or failed to pay amounts owed. You may stop using the Services at any time and may close your account from your settings.
On termination, your right to access the Services ends. Sections that by their nature should survive termination -- including those on intellectual property, confidentiality, fees owed, disclaimers, limitation of liability, indemnity, and governing law -- will survive.
13.Governing law & disputes
These Terms are governed by the laws of the Republic of India, without regard to its conflict-of-laws principles. The parties agree to first attempt to resolve any dispute through good-faith negotiation. Unresolved disputes will be subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka, India.
Where required by applicable law, the parties may instead submit disputes to arbitration under the Arbitration and Conciliation Act, 1996, seated in Bengaluru, in English, before a sole arbitrator mutually appointed.
14.Miscellaneous
- Entire agreement -- these Terms (with any order forms or engagement agreements) form the entire agreement between you and us on the subject.
- Severability -- if any provision is held unenforceable, the remainder will continue in full force.
- No waiver -- our failure to enforce a provision is not a waiver of the right to do so later.
- Assignment -- you may not assign these Terms without our written consent. We may assign them to an affiliate or in connection with a corporate transaction.
- Notices -- we may send notices to the email address associated with your account. You may send notices to legal@opentalent.in.
- Force majeure -- neither party is liable for failure to perform due to causes beyond reasonable control.
- Changes -- we may update these Terms from time to time. Continued use of the Services after updated Terms take effect constitutes acceptance.
